LumisCloud LLC
Effective Date: September 24th, 2025
1. ACCEPTANCE OF TERMS
By accessing or using LumisCloud's web hosting services, you agree to be bound by these Terms of Service. If you do not agree, discontinue use immediately.
2. SERVICES
LumisCloud LLC, a Wyoming Limited Liability Company, provides web hosting services including server space, bandwidth, and related technical support. Service specifications and limitations are detailed in your hosting plan.
3. ACCEPTABLE USE
You may not use our services for:
- Illegal activities or content that violates state or federal laws
- Distribution of malware, viruses, or harmful code
- Spam, phishing, or unsolicited mass communications
- Content that infringes intellectual property rights
- Activities that, in our sole discretion, consume excessive server resources, degrade performance, or disrupt service for other users
Adult content is permitted provided it complies with all applicable state and federal laws.
4. ACCOUNT RESPONSIBILITIES
- You are responsible for maintaining account security and all activities under your account
- Provide accurate registration information and keep it updated
- Comply with all applicable laws and regulations
- You must be at least 13 years old to use our services
- You agree to indemnify and hold LumisCloud harmless from any claims, damages, or expenses arising from your use of services, content you host, or violation of these terms
5. PAYMENT AND BILLING
- Hosting fees are due in advance according to your chosen billing cycle
- Accounts may be suspended for non-payment after 10 days past due
- A 10-day money-back guarantee applies only to the first payment of new customers' first invoice
- The guarantee does not apply to customers who previously held accounts with LumisCloud
- Prices subject to change with 30 days written notice
6. SCOPE OF SUPPORT
LumisCloud provides technical assistance with cPanel and basic hosting functionality. Customer responsibilities include:
- Content management and website development
- WordPress installation, configuration, and maintenance
- Configuration of third-party services (Cloudflare, CDNs, etc.)
- Custom software installation and troubleshooting
- Email client configuration beyond basic setup
7. SERVICE LEVEL AGREEMENT
- We target 99.9% uptime measured monthly
- Downtime is measured by our independent off-site monitoring service
- Service credits are provided for verified downtime as follows:
- 99.0-99.9% uptime: 5% monthly service credit
- 98.0-99.0% uptime: 15% monthly service credit
- Below 98.0% uptime: 30% monthly service credit
- Credits are applied as account credits only and do not exceed monthly hosting fees
- Scheduled maintenance and force majeure events are excluded
8. DATA AND CONTENT
- You retain ownership of your content
- You grant LumisCloud license to host and serve your content as necessary for service provision
- Content-related complaints will be forwarded to you for resolution
- LumisCloud may remove content without notice only for phishing, spam, or illegal activities
- We may provide data backups as a courtesy on a best-effort basis with no guarantees or warranties
- You are responsible for maintaining your own backups of all data and content
9. TERMINATION
- Either party may terminate services with written notice
- LumisCloud may immediately terminate accounts that violate these terms
- Accounts terminated for non-payment or upon customer request will result in immediate data deletion
- All data is permanently removed upon account termination
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMISCLOUD'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
12. GOVERNING LAW
These terms are governed by Wyoming state law. Any disputes will be resolved in Wyoming courts.
13. MODIFICATIONS
LumisCloud may modify these terms at any time. Continued use of services after changes constitutes acceptance of new terms.
14. DMCA COPYRIGHT POLICY
LumisCloud respects intellectual property rights and responds to valid DMCA takedown notices. To file a copyright infringement complaint, your notice must include:
- Physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and its location (URL)
- Your contact information (address, phone, email)
- Statement of good faith belief that use is not authorized
- Statement under penalty of perjury that information is accurate and you are authorized to act on behalf of the copyright owner

Upon receiving a valid notice, we will promptly remove or disable access to the alleged infringing material and notify the customer. Customers may file a counter-notice if they believe the removal was in error.
